General Rental Terms and Conditions 2020




Article 1 – RESERVATION

Booking conditions:
Acceptance of the rental contract by digital or paper signature implies adherence to these general conditions without any restriction.
For any reservation, a deposit of 40% of the total rental price must be paid by bank transfer.
The balance must be paid at the reception desk on arrival.
Reservations will only be considered firm upon receipt of the deposit or full payment of the amount of the reservation.
The customer must specify the exact number of people planned for the stay.
If the number of guests exceeds the authorized capacity, the owner will be able to refuse the additional persons on arrival.
Any modification or breach of contract will be considered at the initiative of the customer.
Our friends the animals are not allowed.

Cancellation conditions:
Any request for cancellation must be sent by e-mail to the following address: info@lacalypsomadagascar.com
Stays booked at the standard rate can be cancelled up to 30 days prior to the arrival date.
In case of cancellation or modification 30 days prior to the arrival date, the establishment will refund the total amount of the reservation.
In case of cancellation or modification 15 days prior to the arrival date, the establishment will refund the amount corresponding to 50% of the total amount of the reservation.
In case of cancellation or modification less than 15 days before the arrival date, the establishment will not refund the total amount of the reservation. This clause is also valid for no-shows.
Non-cancellable and non-refundable rates are subject to full prepayment at the time of booking.
Occasional promotional offers may have different terms of payment and cancellation.
Calypso Madagascar reserves the right to mutualize the reservations in short stay of the villa and the suite.



Article 2 – THE STAY

Length of stay:
The tenant(s) signatory(ies) of the present contract concluded for a fixed period, will not be able to take advantage of any right to remain in the rented premises at the end of their stay. Any occupation exceeding the fixed time limits will give rise to additional invoicing.
The villa and the suite are available on the day of arrival from 2:00 pm and must be vacated by 11:00 am on the day of departure mentioned in the contract.

Inventory:
The accommodations are fully equipped with crockery, cutlery, bedding, sheets and towels. It is expressly forbidden to use the beds without sheets.
A statement of condition and an inventory are given upon arrival of the tenant(s).
On arrival, the tenant(s) must check the condition of the premises and the inventory as well as the proper functioning of the household and sanitary appliances. In high season, the rush and the lack of time do not allow the landlord to carry out this control with the tenant(s).
Consequently, any breakage, damage or lack, not noticed by the owner or his representative must be reported within 24 hours of the tenant's arrival.
After this period, the responsibility of the tenant will be definitively engaged.



Article 3 – INTERRUPTION OF THE STAY

The client will not be able to claim any compensation or reimbursement if he shortens or interrupts his stay for any reason whatsoever, including strike, medical repatriation and other cases of force majeure.

Assignment of the contract:
The eventual assignment of the rental contract can only take place with the written agreement of the owner.
The assignor and the assignee of the contract will be jointly and severally liable to the owner for the rental price.
As no insurance is included in the rental price, we advise you to take out a personal "cancellation insurance".



Article 4 – SECURITY DEPOSIT

Un dépôt de garantie de 500,00€ pour la location sera réclamé le jour de la remise des clés et rendu au départ sous forme d’espèces ou carte bancaire.
Si l’état des lieux et l’inventaire ne constatent aucun problème ou qu’aucun nettoyage particulier ne soit nécessaire sous réserve qu’aucune détérioration ou dégradation cachée n’ai été constatée, il sera restitué au locataire à son départ ou dans un délai maximal de dix jours après le départ, si la restitution immédiate est impossible.
A security deposit of 500,00€ for the rental will be requested on the day of the key collection and will be returned on departure, in cash or credit card.
If the condition of the premises and the inventory of fixtures do not show any problems or if no special cleaning is necessary, provided that no hidden deterioration or damage has been noted, it will be returned to the tenant on departure or within a maximum of ten days after departure, if immediate restitution is impossible.

The following conditions will apply:
The occupants are deemed to have received the villas in perfect condition and equipped with the movable property listed in the inventory given to them upon arrival.
If the condition and inventory of fixtures at the end of the rental period show anomalies, the landlord and the tenant will have to agree on the amount to be deducted from the security deposit. If the deposit is insufficient to pay the sums due by the tenant, the latter undertakes already by signing the present contract to settle any overruns. Damaged goods will be rebilled at the replacement price without application of obsolescence.
The Tenant(s) undertake, at the time of their departure, to return the villa in the same condition as when they arrived and with all the movable property listed on the inventory.
The dwelling must be left free of all rubbish on return of the premises. Cupboards and refrigerator emptied of all food.
Will be considered as missing or damaged, the state of a kitchen and / or dishes not allowing, without special cleaning work, its reactivation to the benefit of the following tenant (s). The amount of this cleaning work will be deducted from the security deposit.
Any lost key or remote control will be charged 50 €.
The Tenant(s) is (are) invited to take out liability insurance to cover any damage that may be caused.
The Tenant(s) is (are) invited to check with the insurer of his (their) main residence the quality of the "resort" risk cover incurred as a result of this contract. A certificate of insurance may be required upon arrival.



Article 5 – PROHIBITION OF LOAN OR SUBLEASE

The sublease, loan or change of residents is not permitted unless expressly agreed to in writing by the Landlord.



Article 6 – CLAIMS

Any possible claim during the stay must be reported immediately to the landlord so that he can solve the problem as soon as possible. The Tenant(s) will not be able to claim compensation in case an urgent repair has to be carried out inside the villa. The breakdowns of a household or other appliance and the delays sometimes necessary to obtain the intervention of a technician or the supply of a component do not entitle the tenant(s) to any particular compensation and are to be considered as incidents of the same nature as those that may occur in the personal home. The owner will ensure that any incident is resolved within a reasonable period of time.
Under no circumstances can any nuisance related to the maintenance of the green spaces of the villa be the subject of a claim giving right to compensation. However, we will ensure that these tasks are carried out as discreetly as possible.
The Wi-Fi network made available to the tenants free of charge may be subject to slowdowns or disruptions in flow, of various and varied origins (breakdown of the Access Provider, saturation of the telephone network, climatic conditions etc...), sometimes preventing connection or surfing in a satisfactory manner.
The owner shall not be held contractually liable in any way.
If the owner or his representative has not been informed before departure, the stay will be considered as having been well spent and no later claim can be considered.



Article 7 – SECURITY, DISTURBANCES, NUISANCES, THEFT

The installations, in particular the swimming pool and equipment of the rented villa must be used in accordance with their purpose and under the full responsibility of the tenant(s).
Use of the swimming pool: take all the necessary precautions for a safe use of the installation, in particular in the presence of young children whose supervision must be constant, despite the provision of an alarm or a safety barrier.
We remind you that it is forbidden to run, push or dive. The swimming pools are not supervised.
Any damage to the premises or destruction of the furnishings in the villas is the responsibility of the tenant(s). This also applies to the persons staying or visitors.
The tenant(s) is (are) responsible for the disturbances and nuisances caused by people staying in the villa. When a resident disturbs or causes nuisances to other residents or damages the integrity of the facilities, his stay may be stopped immediately and without compensation, without prejudice to any claims for compensation that the owner and third parties may assert against him.
Reminder: Article 1394 of the Civil Code stipulates that the customer is solely responsible not only for the damage caused by his own actions, but also for the damage caused by the actions of persons for whom he is responsible, or all the goods (cars, luggage, cameras, jewelry, money, etc.) that he has in his custody. It is therefore up to him to take the necessary measures concerning them. Under no circumstances can the Landlord be held responsible in case of theft of personal belongings both in the Villas and in the parking lot.



Article 8 – DISPUTES AND APPLICABLE LAW

The present General Terms and Conditions will be executed and interpreted in accordance with French law.
Any recourse will be, in the absence of mutual agreement, the exclusive jurisdiction of the courts in whose jurisdiction the rented property is located.
The fact that any clause whatsoever, illegal or inapplicable because of a law, a regulation or following a final decision of a competent court, will not call into question the validity, legality, applicability of the other stipulations of these General Terms and Conditions and will not exonerate the Tenant from fulfilling its contractual obligations.
The Tenant is advised to take out travel cancellation insurance.



Special conditions:

Arrivals: From 14:00 p.m.
Departures: Before 11:00 a.m.
Sheets and towels are provided at no extra charge.
The final cleaning is obligatory and included in the price of the rental which also includes the allotment, the linen supply and the reception of the customers. According to the length of the stay, the owner will have to readjust the basic price.
Night tax per day and per person: 0,15€.
Municipal tax per day: 1,50 €.
Tourist vignette per day and per person 0,60€.
